Deficit Supercommittee Admits Failure
Medicare cuts to hospitals loom under sequester

This week the long-anticipated deadline for the Joint Select Committee on Deficit Reduction ("supercommittee") to develop at least $1.2 trillion in deficits savings has come and gone without a deal. In admitting defeat, the co-chairs of the supercommittee, Rep. Jeb Hensarling and Sen. Patty Murray, issued the following joint statement:

"After months of hard work and intense deliberations, we have come to the conclusion today that it will not be possible to make any bipartisan agreement available to the public before the committee’s deadline...We are deeply disappointed that we have been unable to come to a bipartisan deficit reduction agreement…"

The failure of the supercommittee now initiates the sequester process whereby $1.2 trillion in across-the-board cuts will be applied evenly between defense and domestic programs. Major programs like Medicaid and Social Security are exempted from sequester cuts, leaving, some would argue, defense budgets disproportionately impacted. Defense budgets are on the hook for 50 percent or $600 billion under sequester, prompting U.S. Secretary of Defense Leon Panetta to quickly express grave concern. Panetta also urged Congress to take action within the next year to mitigate these defense cuts.

Medicare providers also face significant cuts beginning in 2013. "Wisconsin hospitals and physicians now face a scenario in which their already below-cost payments will be slashed two percent on January 1, 2013," said WHA President Steve Brenton. "That payment cut amounts to over $90 million annually for Wisconsin hospitals alone, and comes on top of huge cuts already legislated to pay for the Patient Protection and Affordable Care Act (PPACA)." Brenton did note that the Committee’s failure takes "a lot of awful ideas off the table, at least for awhile," including the elimination of CAH eligibility for several Wisconsin rural hospitals.

Since the actual sequester cuts do not take effect until January 1, 2013, the sequester process sets up a tenuous position for Congress and the Administration over the next year—how to find deficit savings in a bipartisan manner without completely going back on their original debt deal (ie: sequester) during a significant and polarizing election year.

Over the course of the past four months, the Wisconsin Hospital Association has had an ongoing grassroots and legislative campaign against Medicare and Medicaid cuts. Those efforts have netted over 2,000 contacts to Congress via several HEAT alerts, trips to Washington, DC to meet with Congress, a Congressional "Dear Colleague" letter and dozens of letters and articles on the subject.

Due Date for PPS and CAH Medicaid EHR Payment Application Extended
Contact WHA to see if DHS has pre-qualified your hospital for payment

The deadline for submission of Wisconsin Medicaid Electronic Health Record (EHR) Incentive Program applications from eligible PPS and CAH hospitals for federal fiscal year (FFY) 2011 has been extended until December 31, 2011.

As a reminder, both PPS hospitals and Critical Access Hospitals can receive a Medicaid EHR incentive payment merely by showing that they have adopted or are in the process of implementing or upgrading to certified EHR technology. Meaningful use is not required to receive a first payment under the Medicaid EHR Incentive Program.

Wisconsin’s Medicaid program has pre-qualified many hospitals for payment in 2011. To see if your hospital is pre-qualified, contact Matthew Stanford at WHA at 608-274-1820 or mstanford@wha.org.

Also, hospitals are reminded that unlike the Medicare EHR Incentive Program, there is no penalty for skipping a year of participation in the Medicaid EHR Incentive Program. Thus, a hospital could receive a Medicaid EHR Incentive Payment for federal fiscal year 2011, and wait until federal fiscal year 2013 to show meaningful use for the first time and thus receive a first Medicare Incentive Payment and a second Medicaid Incentive Payment at that time.

Political Action Spotlight: Wisconsin Hospitals Conduit & PAC Campaign Update - $200k Surpassed

In the last two weeks, 12 new individuals joined the campaign contributing nearly $13,000. This puts the Wisconsin Hospitals Conduit and State PAC fundraising campaign at 81 percent of the goal to raise $250,000 by year’s end. The average individual contribution is $525. In addition, the total to date raised is $202,524 from 386 individuals.

CMS Delays HIPAA 5010 Enforcement, Compliance Date Remains the Same

CMS’ Office of E-Health Standards and Services (OESS) announced on November 17 that they won’t enforce compliance with the HIPAA 5010 transaction set until March 31, 2012. The 90-day delay will not affect the implementation date for the ICD-10-CM/PCS coding systems, CMS said. That date remains October 1, 2013.

CMS did not change the actual implementation date of HIPAA 5010. Providers must still comply with the 5010 transaction standards by January 1, 2012. OESS encourages all covered entities to continue working with their trading partners to become compliant with the new HIPAA standards, and to determine their readiness to accept the new standards as of Sunday, January 1, 2012. While enforcement action will not be taken, OESS will continue to accept complaints associated with compliance with Version 5010 transaction standards during the 90-day period beginning Sunday, January 1, 2012. If requested by OESS, covered entities that are the subject of complaints (known as "filed-against entities") must produce evidence of either compliance or a good faith effort to become compliant with the new HIPAA standards during the 90-day period.

OESS made the decision for a discretionary enforcement period based on industry feedback that testing between some covered entities and their trading partners has not yet reached a threshold whereby a majority of covered entities would be in compliance. OESS has received reports that many covered entities are still awaiting software upgrades.

The HIPAA 5010 transaction set is a precursor to the ICD-10-CM/PCS coding set implementation. On November 17, 2011 CMS held an ICD-10 Implementation Strategies and Planning National Provider Call. The four agenda topics included General ICD-10 Requirements and CMS Implementation Planning presented by Pat Brooks, CMS; General Implementation Planning and Strategies presented by Sue Bowman, AHIMA, and Nelly Leon-Chisen, AHA; Provider and Vendor Readiness presented by Donna Pickett, CDC; and Medicare Fee-for-Service Claims Processing, Billing and Reporting Guidelines for ICD-10, presented by Sarah Shirey-Losso and Antoinette Johnson, CMS.

President’s Column: 100 New Physicians a Year: An Imperative for Wisconsin

WHA will release a report next Tuesday (November 29) calling for concerted and collaborative action to address a looming physician workforce shortage. The shortage will be especially acute for primary care doctors who are expected to lead delivery system transformation through widespread adoption of medical homes—a strategy necessary to achieve improved care coordination and management as the field moves away from fee-for-service based health care delivery and payment.

The report, already vetted and approved by WHA’s board and shared with stakeholders, suggests that there is no "magic bullet" that will meet the daunting challenge of addressing a conservatively estimated shortfall of 2,000 physicians in 2030. But specific issue areas that will address the challenge are identified and specific solutions are discussed. The issue themes include:

Next week’s report is a seminal document that for the first time in recent history documents an emerging crisis and presents a road map for necessary address.

Grassroots Spotlight: Rep. Williams Meets with Hospital CEOs in Hayward

State Rep. Mary Williams (R-Medford) recently met with the WHA Vikingland Region, which convenes quarterly at Hayward Memorial Hospital. Under the newly-redistricted legislative boundaries, Rep. Williams will represent Hayward if reelected in 2012, and the meeting provided an opportunity for her to become better acquainted with hospital CEOs from the area. It also allowed hospital leaders to discuss Medicaid and other proposals impacting Critical Access Hospitals with Rep. Williams.
