EMTALA and the On Call Physician 2008: Ensuring Compliance

Program Description
Every hospital that has an emergency department and accepts Medicare and Medicaid patients must follow the federal law on EMTALA. There are stiff penalties for violating this law, including up to $50,000 fine and exclusion from the Medicare program. This webinar will discuss the EMTALA requirements that hospitals delineate expected response times of physicians on call in minutes and that hospital maintain a list of specific names of on-call physicians and not the group practice's name. In addition, instances of when an on-call physician can consult by telephone and when he/she are required to physically come to the hospital will be discussed.
Learning Objectives
At the completion of this program, the participant will be able to:
- Recall that EMTALA requires that hospitals delineate expected response times of physicians on call in minutes.
- Explain that hospitals must have specific names of physicians on call and not the group practice's name.
- Discuss why a hospital must maintain a list of physicians who are on call to evaluate emergency department physicians.
- Describe when the on call physician can consult by telephone or when are they required to physically come to the hospital.

Sue Dill Calloway has been a nurse attorney and medical-legal consultant for more than 25 years. She has presented numerous educational programs for nurses, physicians, and other health care professionals on topics such as patient safety, the Joint Commission, CMS, and HIPAA issues. Currently, she is the Director of Hospital Risk Management with the OHIC Insurance Company in Dublin, Ohio.

Substitution, Transfer and Cancellation Policy
Cancellations received in writing up to five business days prior to an event will be given a full refund less a $50 processing fee. No refunds will be given for cancellations received less than five business days prior and day-of-program no-shows. Substitutions are accepted.
