Briefs Filed With WI Supreme Court in Dane County Prisoner Dumping Case
Courtroom Advocacy Continues
Briefs on behalf of Meriter Hospital and WHA have been filed with the Wisconsin Supreme Court in the troubling prisoner dumping case, Meriter Hospital, Inc. v. Dane County. As previously reported, this case involves a county prisoner who was at Meriter for a total of 34 days; his medical bills totaled more than $187,000. The county claimed that because the prisoner had been released from custody after the third day of hospitalization, the county was not responsible for the prisoner’s medical bills beyond the first three days. The evidence indicates that the prisoner was released so the County could avoid paying overtime for a required guard at the hospital. The prisoner was in a coma and determined not to be a flight risk. Once the prisoner was released from the hospital, the prisoner was taken back into custody. In addition to avoiding overtime payments, the County is arguing that it should be able to avoid paying for the prisoner’s medical bills.
WHA stressed in its amicus brief that the County is claiming to be entitled to avoid its financial responsibility as a reward for unauthorized conduct. "Without any constitutional or statutory authorization, the County took it upon itself to intervene in the justice system to obtain the release of a habitual criminal. It did this, not because it learned of his innocence or for any other substantive purpose but, by its own admission, in order to save money. It imposed the care and monitoring of this convicted felon, with violent offenses on his record, to the nursing staff of Meriter Hospital."
On behalf of Meriter in its reply brief, Guy DuBeau, an attorney with Axley Brynelson, LLP, argues that Dane County "does not dispute that counties and sheriffs across the state have shown an interest in this case, or that what it did with respect to [the prisoner], if sanctioned, would provide a road map for avoiding the statutory requirement to pay for prisoner care."
Interestingly, in its brief, Dane County argues that, "Meriter’s attempts to ascribe a sinister purpose to the Sheriff fail . . . because there is nothing to prevent the Sheriff from taking the action taken."
The Wisconsin Counties Association also will file an amicus brief in this case. Oral arguments before the Supreme Court are scheduled for September 22, 2004.
Member News: Brown Receives National Rural Health Association Lifetime Achievement AwardThe National Rural Health Association (NRHA) honored Harold Brown, CEO, Prairie du Chien Memorial Hospital, for his dedication and commitment to rural health care by presenting him with the first-ever Lifetime Achievement Award. NRHA hosted a special reception in his honor and presented the award on May 28, 2004 during their annual convention in San Diego.
"NRHA would not be at all where it is today without your faithful, longstanding support and service," Tim Size, executive director of the Rural Wisconsin Health Cooperative, wrote in a letter to NRHA supporting Brown’s award. "If there ever was a guy that put a lie to the belief that one rural hospital administrator can’t possibly make a difference, it is Harold Brown."
WHA President Steve Brenton commended Brown for his dedication to the advancement of rural health.
"Harold is truly a role model, representing the very best that Wisconsin’s community hospitals consistently produce. His track record in Prairie du Chien has been admired and imitated," Brenton said. "The NRHA Lifetime Achievement Award recognizes leadership and vision that his friends and colleagues in Wisconsin have long acknowledged and cherished."
The award is designed to recognize individuals who have truly gone above and beyond in their service to rural health care. Harold Brown is one such individual, and has been singled out for his hard work in this field, according to NRHA President D. David Sniff.
"For more than four decades, Harold has worked hard to continuously improve the lives of so many Americans who live in rural communities," Sniff said. "This award recognizes an outstanding career in service to rural health care."
Harold was not the only Brown to receive recognition. Karen Brown, Harold’s wife, was honored as being one of Wisconsin’s first family practice nurse practitioners.

Governor Vetoes Health Savings Account (HSA) Legislation
Late the week of May 24, Governor Doyle vetoed SB 568, which would have provided a state income tax credit for a portion of an individual’s contribution to an HSA. HSAs are currently deductible from federal income tax. The bill was championed by Sen. Alberta Darling (R-River Hills), Reps. Bonnie Ladwig (R-Racine), Becky Weber (R-Green Bay) and Steve Wieckert (R-Appleton).
As reported in the May 21 edition of The Valued Voice, WHA registered in support of this bill believing that it would increase access to health care, especially for those small business owners who are struggling to provide coverage for their employees. The Governor vetoed the bill because he believed it would benefit higher-income individuals and decrease employer-sponsored health insurance. Reps. Wieckert and Weber disagree and believe that most people utilizing health savings accounts are middle income and uninsured. The Governor also believed that the cost of the tax break for HSAs was too high. The Fiscal Bureau estimated that it would cost the state around $38 million over the next eight years.
President’s ColumnTwo weeks ago, Democratic presidential candidate Sen. John Kerry accused President Bush of ignoring the steady rise in health care costs and pursued that theme during a week-long trek across the nation where he deployed photo opportunities to portray "average" families struggling to pay their medical bills. That’s not the last we’ll hear about health care. The issue will be a major theme this summer and fall as we approach the November elections.
A recent analysis of the Bush and Kerry health plans by Washington Post writer Ceci Connelly described the President’s proposal as "modest" compared to Kerry’s $700 billion, 10-year package that purports to provide coverage to 27 million currently uninsured Americans. Although details are sketchy (probably a wise decision as the greater the detail, the larger the opportunity for critical analysis), Kerry’s program focuses on three major themes:
The purpose of this column is not to disparage the Kerry proposals (President Bush’s reliance on "tort reform" as a health care cost containment strategy is dubious at best). But when it comes to health care cost "solutions" it’s essential that we press for specific details embodied within each and every plan before we embrace the largely symbolic politic rhetoric. Uncovering those details, one might suspect, will be a challenge.

Three Wisconsin hospitals are showcased in the latest edition of AHA’s "Workforce Ideas in Action 4: Case Examples." The hospitals that were included in Volume 4 include: Children’s Hospital of Wisconsin, Grant Regional Health Center, and Gundersen Lutheran. This brings to 14 the number of case examples from Wisconsin. Thanks to WHA members for submitting their examples and leading the way to tackling the tough challenges that surround the health care workforce.
As part of the ongoing work of the AHA Commission on Workforce for Hospitals and Heath Systems, workforce ideas are solicited and published. Volume 4 will be mailed to AHA member hospitals within the next week.
The Wisconsin Society for Healthcare Human Resources Administration and WHA will sponsor a ‘Best Practices’ workshop on September 29 in Brookfield featuring case examples from the AHA’s "In Our Hands" series. Leo Brideau, CEO, Columbia St. Mary’s, who was a member of the AHA Commission on Workforce for Hospitals, will be a featured presenter. Case studies on successful programs that have been implemented in the area of workforce will be presented by WHA member hospitals. September 29 is the date for the workshop, which will be held in Brookfield immediately preceding the WSHHRA fall conference.

Covenant Healthcare System Steps up Advocacy VisitsThe first half of 2004 has been a busy time for advocacy for Covenant Healthcare System as invitations were extended to legislators to tour system hospitals and meet with staff. Sen. Spencer Coggs met with employees at St. Joseph Regional Medical Center in February; Rep. Shirley Krug toured St. Joseph Regional Medical Center in May. Rep. Leah Vukmir will tour The Wisconsin Heart Hospital in June and meet with employees and medical staff. Rep. Ann Nischke will tour St. Joseph Regional Medical Center in June, Sen. Tim Carpenter will visit St. Francis Hospital in July and details need to be completed for visits by Rep. Josh Zepnik to tour St. Francis Hospital, Sen. Gwendolynne Moore to visit St. Michael Hospital and Sen. Tom Reynolds to visit the St. Joseph Outpatient Center later this summer.

Healthy Wisconsin At 72% of Goal
Individuals from Children’s Hospital pushed the number of contributors to Healthy Wisconsin past the 300 mark this week. Colleagues from Covenant Healthcare System, Froedtert and Community Health Care are poised to be added to the contribution champions later this month. Supporters at Meriter, Mercy Health System, The Monroe Clinic and Community Memorial Hospital, Menomonee Falls continue to send in their responses for the conduit, state PAC and AHAPAC.
After two short months, Healthy Wisconsin has reached 72% of its goal with more than 300 individuals making contributions to support advocacy efforts. The campaign trails across the state are beginning to take shape, and Healthy Wisconsin supporters will be a critical element to many of the races. There is ample time for more participation and we look forward to a robust June for Healthy Wisconsin!
