Husch Blackwell has a national reputation for providing exceptional healthcare legal services. Our healthcare law team includes nearly 120 skilled attorneys, all with experience in the healthcare industry. We offer competitive rates, creative use of alternative fee approaches and an efficient staffing model to help healthcare clients advance their unique business goals.

Husch Blackwell is known for the special health law aspects of corporate governance, tax/tax exemption, antitrust, fraud and abuse, employment, information technology, reimbursement, managed care and tax exempt financing that affect all hospitals. Healthcare organizations that seek to streamline operations through mergers, acquisitions, joint ventures and other transactions need legal partners who are clearly focused on the bigger picture as well as the details. Husch Blackwell provides experienced counsel across the life cycle of deals, from initial query to closing. We identify and resolve critical issues regarding due diligence, deal structure, valuation, financing and risk mitigation. Our multidisciplinary team advises on the diverse issues that often arise during transactions, including buyout options, governance and control structures, operating agreements and payor contracts. We also develop and execute communication plans that build political and community support.

In addition, we are also known for our cutting-edge work in developing clinical co-management, mergers and acquisitions, and joint venture arrangements with physicians and creating provider-owned insurance companies. Moreover, in the healthcare employment arena, we have a national Fair Labor Standards Act practice, and we frequently advise healthcare systems on collective bargaining agreements, unfair labor practice charges, union organizing campaigns and the unique aspects of worker’s compensation in hospital settings.

By collaborating across disciplines, our healthcare attorneys offer comprehensive counsel and solution driven services that address healthcare industry pressures. That gives our clients an edge in a challenging industry that is growing rapidly, constantly evolving and facing heightened regulatory and financial scrutiny.

Hospitals and other healthcare providers submit claims to health insurance companies and many policyholders do not fully understand their financial responsibility under a policy. Health insurers may deny claims, in whole or in part, for a number of reasons, including: the treatment was not “medically necessary” or was “cosmetic”; the patient did not obtain pre-authorization for the treatment; the insurer required additional information to process the claim; or the treatment was administered by an “out of network” provider. The patient may receive an Explanation of Benefits (“EOB”) or other document stating that the health insurer is refusing to pay for some or all of their medical expenses. If they believe the health insurance company has denied their claim in error or required them to pay more than their share under the policy, MGW will review the case to see how we can help.
