This presentation examines legal consequences after overdose among a cohort of 400 people who use drugs in Wisconsin. We explored the prevalence of arrest or incarceration after overdose and its association with internalized and enacted substance use stigma. Findings suggest that nearly one in five participants experienced legal consequences after an overdose, and those individuals reported significantly higher levels of stigma than participants who had never overdosed and those who overdosed without legal repercussions. The session will discuss how punitive overdose responses may deter future help-seeking and health care engagement, and will consider policy implications, including the expansion of Good Samaritan Law protections for overdose survivors.
Caitlin Conway is a doctoral candidate pursuing a PhD in Nursing at the University of Wisconsin - Madison. As a nurse working across inpatient and community practice settings, Caitlin has witnessed how individuals, families and communities are impacted by substance use and addiction. Her research focuses on identifying and addressing barriers to the use of substance use disorder treatment and harm reduction services, including the impact of interactions with the criminal legal system. Caitlin is committed to advancing the fields of substance use and harm reduction through implementation of evidence-based practices and advocacy for changes in public policy.
